Recent changes to State Law (RPAPL 881) have strengthened a developer’s ability to obtain access to neighboring properties when that access is necessary for construction.
The "Refusal" Loophole
The underlying subtext of the access negotiations involves delay tactics. Before the law's recent overhaul, developers suffered costly project delays if adjoining owners simply ignored requests. The amendment clarifies this subtext by legally treating a neighbor's silence or failure to respond within 60 days as a formal "refusal," allowing the developer to bypass stalled negotiations and petition the court.
